Details of the “Authorized Listing” Regulation in Real Estate

With the “Confirmed Declaration” regulation that will be implemented by the Turkish Ministry of Commerce as of September 15, it has become possible to authorize more than one real estate agent for the same property, and the license period has been set at 3 months.

The Ministry has determined the foundations and procedures of the “Authorized Advertisement” system that will be implemented with the aim of preventing harm to the consumer and price manipulation that citizens face through fake advertisements.

According to the application, people who will sell a house will choose their properties through the e-government and authorize their real estate agent from the window that will open, and thus real estate agents will be able to publish advertisements on the sites with the authority they receive.

According to the letter sent by the Ministry to the relevant non-governmental organizations on this subject, with the implementation of the relevant regulation, companies will not be able to publish advertisements and it will be mandatory after January 1, 2025.

It is important for real estate companies that operate without a license certificate to obtain this document to avoid problems when publishing advertisements and avoid administrative penalties after activating the license verification in the Electronic Listing Verification System (EIDS).

Advertising platforms are scheduled to complete the technical work on the authorization verification request by September 15, and the system will be operational from that date.

A logo or phrase will be included in the advertisements published after verification stating that “authorization has been verified by EIDS”.

The application will be fully operational as of January 1, 2025, and no advertisements can be placed after this date without verifying the license.

It will be possible to license more than one real estate activity for the same property. In the event that there is another advertisement for the same property on the advertising platforms, shortcuts or links containing information about the price of the other advertisement will be included.

It will be possible to cancel the authorization granted by the property owner in the electronic government transactions authorizations screen, but in the event of canceling the authorization, the advertisement will not be automatically deleted from publication.

In the event of renewing the advertisement, the authorization will be inquired about again.

The duration of the authorization required from the property owner in the authorization screen will be at least 3 months, and the duration of the authorization granted by the property owner can be extended from the same screen.

EIDS license verification request will be mandatory for both real estate sale and rental advertisements, immovable properties that do not have a title deed for any reason such as daily rental properties, residential projects for which a floor easement has not yet been established, housing projects of the Mass Housing Administration and the Emlak Konut Real Estate Investment Partnership and immovables that qualify for slums will not be included in the application.

Advertisements for immovable properties that do not have title deeds can be placed on the platforms, but at the entrance to the advertisements for these immovable properties, a sign will be placed indicating that the immovable properties do not have a title deed record and this will be stated in the advertisement.

The information of the province, district, island and plot will be included in the advertisement in an unchangeable way, but the neighborhood information will be changeable.

Advertisements published when the application was launched will remain, in case the advertisements in the publication are renewed, the license will be inquired through the EIDS system.
